If I decided not to return to work after my maternity leave, do I have to repay my maternity pay to my employer?

Iwork for NHS, maternity policy states you have to work 3 months on your return or pay back some of your maternity payx

SMP isn't repayable to your employer but our contracts state that you need to return to work for a minimum of 3 months so as you don't owe anything - otherwise you will have to re-pay 2 weeks of full pay OMP.

Maternity pay repayments are dependant on which maternity leave your on. Your company can give you your full wages for the full term your off. With this if you dont return to work for 3 months yes you have to pay some back. Your company can give you 6 weeks 90% wages and then £114 a week from then on untill your 30something weeks. This you do not have to pay back if you dont go back to work. Also one more thing you can claim working tax credits whilst on maternity pay which is great. and helps allot hope this helps.
